USCIS requires a Dun & Bradstreet listing
H2A Employers must be registered with Dun & Bradstreet and the address should match your H2A application. Not registering with Dun & Bradstreet may cause USCIS to issue a Request for Evidence (RFE) which will delay approval and the workers arrival.

Department of State and Consulate Appointments in Mexico
Starting October 1, 2025 Applicants renewing an H2A visa within 12 months of their previous visa's expiration will not need an interview unless requested by a Consular Officer.
All other visa applicants must be interviewed with three day procesing.

The Department of Labor Reduces AEWR Wages for H2A Labor
The Department of Labor (DOL) released an interim final rule (Rule) revising the methodology used to determine the Adverse Effect Wage Rate (AEWR) for H-2A agricultural workers. For the vast majority of H2A jobs the wages are decreased for field and livestock worker occupations.

Staggered Start Dates
New rules as of October 1st, 2025 allow for more flexibility and less paperwork for H-2A employers. Employers may now list multiple start dates on a single application. Read the new regulations about staggering start dates below.

Department of State and Consulate appointment process
After receiving approval from the Department of Labor and USCIS, workers may begin to have their appointments scheduled at consulates ran by the Department of State. Occupational Safety and Health Administration Field Sanitation Standard
The Occupational Safety and Health Act of 1970 (OSHAct) was enacted to assure safe and healthful working conditions for working men and women. In 1987, the Occupational Safety and Health Administration issued regulations establishing minimum standards for field sanitation in covered agricultural settings. These standards required covered employers to provide toilets, potable drinking water, hand-washing facilities, and information regarding good hygiene practices.
